The Power of Attorney service (commonly known as a “POA”) legally authorises a person or persons whom you trust to assist you with your finances. This could be as simple as paying the bills on your behalf. Or it could be dealing with the local authority, benefit offices and other financial institutions.

​The Power of Attorney in Scotland documentation requires to be registered with the Office of Public Guardian. The POA cannot be legally used by your appointed Attorney(s) until registration. If you do not have a Power of Attorney in place:

Financial: Your assets could be automatically frozen. For example: your bank accounts, savings, investments etc. This could mean that essential bills may not be paid. This can cause unnecessary stress and hassle for your family or loved ones. Your family and loved ones feel the impact. They have no authority to assist you with your financial affairs.

Welfare: Nor will they be able to ensure that the right decisions are made about your health and welfare requirements. If care is required, there would be no-one in place to legally assist you with the arrangements.

Local Authority powers: If you went into a Care Home the Local Authority would take over and make all the necessary arrangements. This may result in the arranged care facility not at a level you and your family would have wanted. It may also not be at a location suitable for family visiting.

Joint property ownership: In the case where you have joint ownership of a property title. Your spouse or partner would be unable to sell the property until you died. This issue is becoming more prevalent nowadays. Often the spouse or partner considers that it would be sensible for them to “downsize” to a more suitably sized property.
